LIABILITY RELEASE, WAIVER, DISCHARGE, AND COVENANT NOT TO SUE
Liability Release and Assumption of Risk – Private Property of the Causey Trust, used by T.F.C Tactical for firearms and tactical training activities. This Release is executed and given by myself, on behalf of myself and every participant included in this booking, to Cornell Causey and T.F.C Tactical. I am mentally and physically capable of participating in the recreational activities on the private property located in the vicinity of 2724 Watson Lake Road, Fayetteville, NC 28306, owned by Causey Trust. I fully understand/acknowledge the dangers, hazards, and risks inherent in the proposed recreational activities and entering the private property of Causey Trust. Due to the terrain and location of the property at 2724 Watson Lake Road, Fayetteville, NC 28306, dangers include but are not limited to falls, cuts, bruises, injury, property damage, serious physical injury, sickness, and death.
I agree to participate, and to allow all participants in this booking to participate, in any/all activities conducted at 2724 Watson Lake Road, Fayetteville, NC 28306. As a customer, I understand the dangers, hazards, and risks of participating in all activities. I, the undersigned, agree to assume all risks and responsibilities surrounding participation in activities conducted at 2724 Watson Lake Road, Fayetteville, NC 28306. I understand and agree that anyone involved in the following activities: weapons usage, firearms training, all-terrain vehicle (ATV) riding, axe-throwing, and archery — including training and sessions conducted by T.F.C Tactical — assumes responsibility for any injury or damage that might arise. I also assume all risks and hazards that may occur from natural disasters or environmental hazards, to include any and all animal, insect, or plant injuries. Emergency Medical Treatment (EMT) will be immediately contacted in the event of a medical emergency.
I release/hold harmless Releasees, T.F.C Tactical, and its owners, instructors, and staff, and the members of their families and spouses, on behalf of myself and every participant in this booking. My estate, family, heirs, administrators, personal representatives, or assigns, and those of every participant in this booking, may not sue Cornell Causey, T.F.C Tactical, and all other Releasees, Contractors, Instructors, or Property Agents, whether alive, medically incapacitated, or deceased.
I further agree to save and hold harmless, indemnify, and defend Cornell Causey, T.F.C Tactical, and all involved in the activities and present on the private property from any claim by my family, friend, agent, or me, or by any participant in this booking or their family, friend, or agent, arising out of participation in any activities or being present during any activities within the vicinity of 2724 Watson Lake Road, Fayetteville, NC 28306.
In signing this waiver and release of liability form, on behalf of myself and every participant listed in this booking, I acknowledge that I have fully read and understand the contents of this document. I understand that signing this document is my free act and deed; no oral representations, statements, or inducements, apart from the preceding written statement, have been made. I further state that no health-related reasons or problems preclude or restrict my or any participant's participation in any recreational activities mentioned in this document. I am solely responsible for having adequate health insurance to cover any associated medical costs acquired from sustained injuries, for myself and every participant in this booking.
